1. Definitions

In these Terms and Conditions:

• "Calmtide", "we", "us", "our" refers to the business operating at 83 Rat Uthit 200 Pi Road, Patong, Phuket 83150, Thailand.
• "Service" refers to the information talks, document sorting sessions, membership programme, and related resources provided by Calmtide.
• "User", "you", "your" refers to any person who accesses our website, attends a session, or enrols in a membership.
• "Agreement" refers to these Terms and Conditions as accepted by the User.

2. Acceptance of Terms

By accessing our website, submitting an enquiry, or attending a Calmtide session, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

You must be at least 18 years of age to use our services. By using them, you confirm that you meet this requirement.

3. Nature of Service — Important Notice

Calmtide provides general education, plain-language information, and document organising support only. Our sessions and materials do not constitute:

• Individual financial advice
• Legal advice
• Tax advice
• Regulated financial planning or investment guidance
• Representation before any government body, regulator, or pension authority

Nothing shared in our sessions or materials should be relied upon as a substitute for professional advice tailored to your personal circumstances. We always encourage participants to consult the relevant official bodies, regulators, or qualified professionals for individual matters.

4. Service Description and Availability

We offer three main service options as described on our website. Session schedules, availability, and pricing are subject to change with reasonable notice. We reserve the right to cancel or reschedule a session; in such cases, participants will be offered an alternative date or a full refund of any session fee paid.

5. Bookings and Payment

Session fees are as stated on our website at the time of booking. Payment terms will be confirmed at the time of booking. Prices are in Thai Baht (฿). A booking is confirmed once payment (or agreed arrangement) is received.

Cancellation by participant: Cancellations made more than 48 hours before a session will receive a full refund. Cancellations within 48 hours may be transferred to a future session date at our discretion; refunds in these cases are not standard but may be considered on request.

Membership: The Gentle Learning Membership may be cancelled at any time by notifying us in writing at [email protected]. No refunds are provided for partial membership periods already accessed.

6. User Responsibilities

You agree to:

• Provide accurate information when making an enquiry or booking
• Attend sessions in a respectful manner towards facilitators and other participants
• Not record, reproduce, or distribute session content without prior written permission
• Not rely on session content as individual professional advice
• Handle your own personal documents — Calmtide staff assist with organising but do not retain or process your documents on your behalf

7. Intellectual Property

All content on the Calmtide website and in session materials — including text, structure, and design — is the property of Calmtide. A limited, personal, non-transferable licence is granted to Users to view and use this content for personal, non-commercial purposes. No content may be reproduced, distributed, or used commercially without written permission.

8. Disclaimer

Our services are provided "as is" for general informational and organisational purposes. We make no representation that general information shared in sessions is complete, current, or applicable to your individual circumstances. Pension regulations and official procedures vary by country and change over time; participants should verify relevant details with official sources.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Calmtide will not be liable for any indirect, consequential, or special loss or damage arising from use of our services or reliance on information shared in sessions. Our total liability to you for any claim arising from our services will not exceed the amount paid by you for the session in question.

10. Termination

We reserve the right to decline or terminate access to our services for any individual whose behaviour is disruptive, disrespectful, or contrary to the inclusive and calm environment we maintain. Memberships terminated on these grounds will not receive a refund for unused periods.

You may discontinue use of our services at any time. Cancellation of membership should be notified in writing.

11. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage an informal resolution process first — please contact us at [email protected]. If an informal resolution is not possible, disputes will be subject to the jurisdiction of the courts of Thailand.

12. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. These Terms constitute the entire agreement between you and Calmtide in relation to use of our services and supersede any prior understanding.

We may update these Terms from time to time. Continued use of our services after an update constitutes acceptance. Changes will be published on this page with an updated effective date.
